1. Who this agreement is with
Utuh is a product of Angkut Digital Enterprise (SSM Reg. No. 202603226777), a business registered in Malaysia ("Utuh", "we", "us"). These Terms of Use govern access to and use of the Utuh service (the "Service") by any business or individual that creates an account ("you", the "Customer").
2. The Service
Utuh is a fleet compliance, cost-tracking, and safety platform for Malaysian SME operators of trucks, motorbikes, and cars. The Service does not require GPS hardware or any physical installation; it is accessed via a web browser by the Customer and, via a driver-specific link, by the Customer's drivers.
3. Accounts and plans
You must provide accurate information when creating an account. Free and paid subscription tiers are described on the Pricing page and may change with notice. Paid tiers include a 30-day free trial; no payment method is required to start a trial.
4. Acceptable use
You agree not to use the Service to store or transmit unlawful content, to misrepresent vehicle compliance status, or to attempt to circumvent the Service's security or access controls. You are responsible for the accuracy of data your drivers and staff enter.
5. Data and content ownership
You retain ownership of the data you and your drivers submit (vehicle records, checklists, receipts, photos). You grant Utuh a licence to process that data solely to provide and improve the Service. See the Privacy Policy for how personal data is handled.
6. Availability and support
The Service is provided on an "as available" basis. We aim for high uptime but do not guarantee uninterrupted access. Support channels and response times are described in your plan.
7. Fees and cancellation
Paid plans are billed on a recurring basis via our payment processor. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
8. Termination
We may suspend or terminate access for material breach of these Terms, non-payment, or unlawful use of the Service, with notice where practicable.
9. Limitation of liability
To the maximum extent permitted by Malaysian law, Utuh is not liable for indirect or consequential loss arising from use of the Service. The Service assists with compliance record-keeping; it does not replace the Customer's own legal obligation to comply with applicable transport, safety, and labour laws.
